These Terms of Use (“Terms”) govern your access to and use of the website at studio.steeltoetech.com (the “Site”), operated by Steel Toe Technologies, Inc. (“Steel Toe,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. These Terms do not govern client engagements

This is a website document. If you engage Steel Toe for services, that work is governed by a separate Master Services Agreement and a Statement of Work signed by both parties. Those documents — not these Terms — determine scope, fees, ownership of what we build, warranties, confidentiality, and liability for an engagement.

Nothing on the Site, and nothing in these Terms, creates a client relationship or obligates either of us to enter one.

2. Information on the Site is not advice

Content on the Site — including articles, guides, pricing illustrations, and estimates — is provided for general information only. It is not legal, regulatory, compliance, financial, or engineering advice, and it is not a substitute for professional judgment. Do not act on it without appropriate advice for your situation.

Any price, timeline, or scope shown on the Site is a good-faith illustration, not an offer. Nothing becomes binding until it is set out in a signed Statement of Work.

3. Acceptable use

You agree not to:

  • Use the Site in violation of any law, or to infringe anyone’s rights.
  • Attempt to gain unauthorized access to the Site, its systems, or any account.
  • Probe, scan, or test the vulnerability of the Site without our prior written permission.
  • Interfere with or disrupt the Site, or impose an unreasonable load on it — including by scraping or automated collection that degrades service for others.
  • Misrepresent your identity or affiliation, or use the Site to send unsolicited commercial messages.

4. Our content

The Site and its content — text, design, graphics, logos, and code — are owned by Steel Toe or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive licence to view and use the Site for your own informational and business purposes. All rights not expressly granted are reserved. “Steel Toe,” “Steel Toe Studio,” “Thalos,” and “Atlas” are our marks; you may not use them without our permission.

5. Anything you send us

If you send us feedback, suggestions, or ideas through the Site, you agree we may use them without restriction or obligation to you. Do not send us confidential information through the Site. Material you submit through a public form is not treated as confidential. If you need to share something sensitive, ask us for a confidentiality agreement first.

6. Third-party links

The Site may link to third-party websites and services. We do not control them and are not responsible for their content, practices, or availability. A link is not an endorsement.

7. Availability and changes

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms; when we do, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect means you accept the revised Terms.

8. Disclaimer

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or that its content is accurate or current.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STEEL TOE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUE, ARISING OUT OF YOUR USE OF THE SITE. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). This section applies to the Site only; liability for an engagement is governed by the Master Services Agreement.

10. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in New Castle County, Delaware for any dispute arising out of or relating to the Site or these Terms.

11. Privacy and related policies

Our Privacy Policy explains how we handle personal data. Our AI Use Policy explains how we use artificial intelligence in our work, and our Sub-processors page lists the service providers that process data on our behalf.
